Republican Party of Rutherford County RIGHT Card Terms and Conditions

These Terms and Conditions ("these Terms") govern the Republican Party of Rutherford County RIGHT Card program ("Program"). The Program is designed to encourage membership in and continuous funding of the Republican Party of Rutherford County ("Party"). For that reason, all Party members automatically become Program members, but Party membership still is subject to Party bylaws, regardless of whether or not you become a Program Member.Program membership is open to any U.S. resident age eighteen (18) or older with a valid credit or debit card that can be processed electronically over the Internet. If you use a Program membership card ("RIGHT Card"), you explicitly accept these terms in their entirety and waive both the right to decline these Terms, and any and all recourse for any claim or controversy arising out of or in connection with the Program, except as may be provided for explicitly in these Terms. If you wish to decline these terms, you must remit the RIGHT Card before use by mail or in person to the Party headquarters. These Terms are subject to change at any time at the Party's sole discretion, with or without notice. It is your responsibility to check for updates to these terms; if you continue to use your RIGHT Card after these terms have changed, you automatically accept any and all changes.

The words "purchase" and "subscription" and other related words and phrases in these Terms are used loosely and for the purpose of brevity. The Party is and remains a political party nonprofit organization, and any such "purchase" or "subscription" or other thing pursuant to these terms nonetheless constitutes a donation to the Party, subject to applicable laws governing donations to political parties.

What's in It for Individuals

As an individual, when you pay for a Party or Program membership, you receive a Party membership card called a RIGHT Card. Your RIGHT Card can be presented in person at participating businesses listed at the Party website www.RutherfordGOP.org ("Website") in exchange for promotional pricing and/or products ("Benefits" or "Offers") provided by the business. Each participating business sets its own rules for whether or not you need to show proof of identity in order to receive Benefits. Some businesses may require you to take additional steps such as ordering another card in order for you to receive Benefits; national chains especially may require a separate card but may offer benefits at any or all of their locations. Photocopies or other duplicate RIGHT Cards are not guaranteed to be accepted, regardless of whether or not you have paid for an original RIGHT Card.

Replacements, Cancellation, and Refunds for Individuals

If you lose your RIGHT Card, or if it is stolen, please contact the Party Headquarters at (615) 893-7219 or by visiting the Contact Us page of the Website. The Party does not guarantee to replace lost or stolen cards without additional cost.

Before your RIGHT Card has shipped, your subscription can be cancelled as specified in the order confirmation email sent once your order is complete. To cancel your Program membership after your RIGHT Card has shipped, you may remit the RIGHT Card by mail or in person to the Party headquarters at 111 E. Main St., Murfreesboro, TN 37130. You may be able to cancel the recurring billing yourself, through the service provider handling billing as described in the Billing and Privacy Policies below. Cancellations requested through the Party will be processed as promptly as possible, but when you order a RIGHT Card, you specifically agree to a delay of up to one full billing cycle before your billing is cancelled, so you may automatically be billed again before the recurring billing is cancelled.

Canceling your Program membership does not necessarily automatically cancel your Party membership. To cancel your Party membership, please visit the Party headquarters mentioned above, call (615) 893-7219, or visit the Contact Us page of the Website.

Because all funds collected from this program are donations to the Party, refunds are not guaranteed, except as may be required by law.

What's in It for Businesses

As a business, when you participate in the Program, you receive one RIGHT Card for your exclusive use, you agree to provide Offers exclusive to Program members, and your business and respective Offer or Offers are advertised on the Website. Your business RIGHT Card may be visually or physically different from those provided to Program members, and you may not give, loan, lend, or sell your business RIGHT Card to anybody. If you lose your business RIGHT Card, or if it is stolen, please contact the Party Headquarters at (615) 893-7219 or by visiting the Contact Us page at the Website. Additionally, by participating in the Program, both you and the Party grant each other the nonexclusive, unlimited right to use each other's name, logo, slogans, trademarks, service marks, and other appropriate intellectual property for the purpose of advertising.

Cancellation for Businesses

You may cancel your participation in the Program at any time by written, electronic, verbal, or other means by contacting the chairman of the Party Membership Committee, Special Events and Fundraising Committee, or Outreach and Development Committee as listed on . If you choose to cancel your participation in the program, your cancellation will not be effective until the Party or its designee has confirmed your request to cancel. Once your participation in the Program is cancelled, both you and the Party will have (30) business days to cease using each other's intellectual property. Even after you cancel, your obligations to honor Benefits for Program members will continue until your intellectual property is removed from the Website, unless you conspicuously advertise in writing to the contrary at the entrance to your business.

Terms of Sale and Delivery Policy

Program memberships can be purchased from the Website by visiting the appropriate page and completing the online purchase process. Program memberships purchased via the Website are offered and sold only as a subscription. Your RIGHT Card will be sent within thirty (30) days after the Party receives your order and will be delivered by U.S. Postal Service or other means. Your RIGHT Cards is valid until the date indicated on the card. For subscribers, RIGHT Cards will be created and disbursed by the Party annually and are not guaranteed to be sent until after the appropriate anniversary of the Member's subscription. For Party members who have not subscribed through the Website, new RIGHT Cards will be sent only after paying the party's annual dues. Regardless of how you receive your RIGHT Card, there may be a short time each year between the expiration of your old RIGHT Card and the time you receive your new RIGHT Card. During that time, you may not receive Program benefits since participating businesses are not obliged to honor expired RIGHT Cards, and you agree to hold the Party harmless for any Program benefits you do not receive because of this policy.

Billing and Privacy Policies

The Party receives credit and debit transaction services from certain service providers in order to receive funding from the purchase of the RIGHT Card. When you purchase a subscription, you agree to allow the service provider to retain a copy of whatever personal, banking or other information may be necessary for the continued billing of your subscription. The storage and security of the said information is subject to the applicable terms and conditions, privacy policy, or other information provided by the service provider, and you agree to hold the Party harmless for any claim or controversy arising out of the service provider's handling of your information.

Once your participation in the Program meets or exceeds the standards set in the Party bylaws for membership, you automatically become a Party member. Because Program memberships are sold with the intention of growing the Party, your personal information will be collected when you purchase your RIGHT Card. This information includes your name, address, telephone number, and email address, and may include anything else that you provide during the purchase process. The Party may share your personal information with anyone legitimately attached to the Party, including but not limited to the Tennessee Republican Party or its representatives, the Republican National Committee or its affiliates, Party members, and anyone else with a legitimate need or use for your information, within the bounds of applicable law.

Customer Service

Generally, if you need customer service from the Party, please contact us at (615) 893-7219, visit our headquarters at 111 E. Main St., Murfreesboro, TN, 37129, or contact us at the Website. Since the Party headquarters are not open every day, your call may not be answered immediately, so please leave a message and allow four calendar days (holidays not included), for the Party to return your call. The Party will make a reasonable attempt to satisfy your request for service. If the Party exceeds its obligations under these Terms, it does not constitute a guarantee or expansion of the Party's future obligations, with respect to you or anyone else.

If you are a Program Member and have a dispute with a participating business, or if you are a participating business and have a dispute with a Program Member, you agree to hold the Party harmless, and the Party will not intervene on either party's behalf. Any form of recourse you may have for such disputes will be subject to applicable law or published policy.

If you are a Program member and have a dispute with the Party, you agree to settle your dispute by informal, third party arbitration.

If you are a participating business and have a dispute with the Party, the dispute may be settled in small claims court, and in no case shall damages arising out of any such dispute exceed two thousand, five hundred dollars ($2,500).
